Please note that work which is more involved than just general advice, and is specific to a Council’s particular needs may have to be contracted directly to that Council, at a cost to the Council.

PD Solutions will also have to agree a Data Processor Agreement with any Council who wish to work directly with them before they can access sensitive Employee data.

Member Council Dispute Resolution Package 

The Dispute Resolution Programme

Consists of three modules helping Councils to resolve Code of Conduct complaints from Employees. The purpose of the programme is to help Councillors to understand their role as Employers, the Employment Laws that affect how they carry out that role, and practical steps to address employment disputes.

The benefit of this Programme is that it is accessible to all Members of a Council, regardless of their time constraints, or reluctance to attend training or similar events.  Employee disputes and Code of Conduct complaints against a Councillor can make that reluctance worse, as they may not want to attend something where they think they may face criticism. This Programme overcomes that reluctance as Councillors can watch it in their own time, wherever they want.

Module One – Awareness

Helps Councillors and Employees understand their role as Employers and Managers.  It explains the unique working environment that makes Town and Parish Councils very different from other Employers, and how that environment is prone to disputes.

It helps Councils effectively exercise their management responsibilities and understand what they can and cannot do.

Cost   -   £150 + VAT

 Module 2 – Legal Framework

This helps Councillors and Employees understand the unique Employment Law framework, as well as the challenges faced by Town and Parish Councils, in resolving Employee disputes with Councillors.  It addresses:

  • The causes of conflict and disputes.
  • What legal action can be taken against Councils and Councillors who mismanage Employee disputes.
  • Understanding the ACAS Guidelines and requirements of the Localism Act 2011 for resolving Employee disputes and Code of Conduct complaints.

Cost   -   £150 + VAT

Module 3 – Practical Issues

How to take reasonable and effective steps to resolve Employee problems, and protect the Council, including:

  • The importance of employment procedures that are fair and transparent, right for small organisations and understood by all parties, as required by the ACAS Guidelines.
  • Understanding the difference between a Grievance and a Code of Conduct complaint.
  • Steps to support an Employee whose health is affected by a dispute.
  • Supporting an Employee to make a balanced, evidenced and professional complaint to the Monitoring Officer, if necessary and appropriate.

Cost   -   £150 + VAT

All modules are 30 minutes long and can be emailed to Councillors and Employees to watch at a time that is convenient to them. 

Part Four

A 30-60 minute Zoom meeting with a Council to help Members address disputes, and applying the three modules to their issues.

Cost   -   £250 + VAT

  • The cost per module if £150 + VAT and must be paid before deliver of the video.
  • Each video is solely for the use of the Council we send it to and cannot be resold.
  • In the event that a Council or Councillor does supply one or more of the videos to a third party outside of the Council we send it to, the Council agrees to reimburse Personnel Advice and Solutions for all loss of revenues.
