Delivery of Nomination Papers

Whilst there is currently no requirement that candidates attend in person to deliver their own nomination papers, it is not the role of the Community, Town or Parish Council to provide support for this. Choosing to stand for election is a private matter for the individual concerned and this applies to both current and new candidates.

Local Councils, or their officers, are under no obligation to deliver Councillor Nomination Forms to the Electoral Services point prior to an Election.

Should a council determine by resolution that they will instruct the Clerk to facilitate collection of nomination forms and take them to the Electoral Office, then they must recognise this time as being within the existing contracted hours and any expenses incurred, should be repaid. If there is insufficient time within the contracted hours, it may be necessary to agree paid overtime to accommodate this. The person delivering the forms is required to wait, whilst they are processed.

Furthermore, the service should be advertised and offered to other independent candidates so that there may be no question of favouring one set of candidates over any other candidate.

Owing to the already significant pressures on the Clerk’s time and the private nature of this business, it is BMKALC’s recommendation that the Clerk should not be delivering the nomination papers for candidates to Electoral Services.
